On May 24, 2018, a Saskatchewan judge found that sections 31 and 65 of the Vital Statistics Act 2009 violated section 12 of the Saskatchewan Human Rights Code. As such, the court ordered the government to remove the requirement for gender designations to be present on birth certificates; the age restriction was also ordered to be lifted. The court has given the government 45 days to comply with the order. Saskatchewan’s ‘Gender Marker’ section has been updated to reflect the ruling and the process as it presently stands; we will be watching closely for published changes in the process.
